Rachael Lauren Smith, 24, formerly a teacher at Mount Clemens High School, was sentenced to serve 270 days in Lapeer County Jail after being convicted of one count of fourth-degree criminal sexual conduct with a 17-year-old student. Smith, of Imlay Township was arraigned in June in Lapeer County District Court on three counts of third-degree criminal sexual conduct with a student and furnishing alcohol to a minor. She was released on a $10,000 personal bond. Although the age of consent is 16 in Michigan, state law prohibits teachers from engaging in sex with students regardless of age. According to the Macomb Daily article, during plea negotiations, the prosecutor’s office dropped three counts of third-degree criminal sexual conduct with a student and furnishing alcohol to a minor. Had Smith been convicted on the third-degree CSC, she would have faced up to 15 years in prison. The fourth-degree criminal sexaul conduct is considered a high-court misdemeanor, but treated as a felony for law enforcement purposes. Smith had no prior criminal history.

Timothy Flasik, 28, of Missouri City, was sentenced Oct. 9 in Criminal District Court No. 297 to 15 years each on three charges of sexual performance of a child, two charges of sexual assault of a child under 17 years old and one charge of delivery of a controlled substance (marijuana) to a minor. The sentences will be served concurrently.He previously pleaded guilty in July to six charges related to the case. He will have to serve at least half of his sentence before he is eligible for parole. Flasik resigned from the Hurst-Euless-Bedford school district at the end of the 2013-14 school year. Hemust register as a sex offender for the rest of his life, according to Tarrant County court records.

Rachel Bauer, a former agriculture teacher at Frankston High School, about 90 miles southeast of Dallas, was sentenced to 10 years in prison on October 8 after reaching a plea agreement. Under the terms, Bauer will also serve 10 years deferred adjudication probation on a second-degree felony charge of sexual assault following her prison term. If she fails to complete the terms of her probation, she stands to face up to 20 years in prison again and lifetime sex offender registration.Bauer reportedly sent pornography photos of herself and engaged in drinking and sex parties with three male students at her home.
